TERMS OF SERVICE / CONTEST RULES

1.0 INTRODUCTION

The name of the game is HAMMER INTERACTIVE GAMES (“the Contest”) and it is offered by Hammer Games Limited (“Hammer Games” or “We” or “Us” or “Contest Sponsor”).

One of the distinctive features of Hammer Games is the presence of an in-app currency known as “Cowries {CWR}” and our loyalty offering in the form of “Gems”. The cost of participation in the pay mode of the contest is converted to cowries.

Hammer Games offerings include Hammer Lucky Draw, Odogwu Hunter, Free App Activities and Spin and Win/Wheel of Fortune.

These Terms of Service and Contest Rules ("Terms/Rules") establish a legally binding agreement between users ("you" or “Your” or "User" or “Participant” or “Contestant” or “Player”) and Hammer Games, thereby governing your access and usage of the Contest.

By utilising or interacting with any component of the Contest, you signify your consent to be bound by these Terms/Rules.

It is therefore of paramount importance that you carefully review and understand these Terms/Rules before engaging in the Contest.

Note that your continued participation in the Contest implies your full acceptance and adherence to these Terms/Rules.

2.0 DATA PROTECTION AND PRIVACY POLICY

We care about data privacy and security. Please review our Data Protection and Privacy Policy By participating in the Contest, you agree to be bound by our Data Protection and Privacy Policy.

3.0 ACCEPTING OUR TERMS/RULES

These Terms/Rules constitute a legally binding agreement made between you (whether personally or on behalf of an entity) and us, concerning your participation in the Contest.

You hereby agree that by accessing the Contest, you have read, understood, and agreed to be bound by all of these Terms/Rules.

IF YOU DO NOT AGREE WITH ALL THESE TERMS/RULES, YOU ARE EXPRESSLY PROHIBITED FROM ACCESSING THE CONTEST AND YOU MUST DISCONTINUE YOUR ACCESS IMMEDIATELY.

4.0 IN-APP CURRENCIES

The contest is administered utilising a unique in game currency and our loyalty scheme is built on loyalty points as provided for below:

Cowry {CWR}:

• Cowries are the Contests’ in-app currency, as users/players fund their wallet, their money will automatically be converted to Cowries on a 1:2 basis, making 1 Naira = 2 Cowries.

• Gems are the bedrock of our loyalty program and will be awarded to users/players as points to encourage them to perform more activities in the Contest daily. Thus, the more users/players utilise the Contest, the more gems they earn.

5.0 PARTICIPATION:

To participate in the contest, a player can enter either through the free mode or pay mode. By entering the contest, a player agrees to abide by and be bound by the official contest rules and regulations and consent to the use of their personal information to administer the contest.

The contest will be open to all registered users of HAMMER INTERACTIVE GAMES who are 18 years and above {18+} or the applicable age of maturity, being legal residents of Nigeria.

An intending participant shall register through the contest website or download the contest app from the Google Play Store or App Store (Contest Platform). A contestant shall be required to provide detailed and accurate personal information and must consent to Hammer Games' data protection and privacy policy and these Terms/Rules.

Double registration by a single individual is not allowed and where such occurs, it shall be treated as fraud.

During registration participants can register using their email, Facebook accounts, Gmail accounts or other Google accounts.

Correspondence with contestants shall be through the Contest Platform or registered email.

Contestants can always access and update their information when necessary through the settings button on their Dashboard/Home page in the Contest Platform.

A. ACCOUNT INFORMATION: A Contestant is required to accurately fill out the account information section in the Contest Platform, ensuring it matches the details in their bank account. Providing incorrect or conflicting information may hinder financial transactions, particularly when requesting withdrawals, as bank protocols for cash transactions/transfers will be enforced.

B. FREE MODE PARTICIPATION: Contestants can access the contest in the free mode and win Gems as part of our loyalty program in the following ways:

Playing games

Completing missions

Purchasing in-app assets

Daily logins (minimum of 30 minutes a day)

Sharing Hammer games with friends (referrals)

Daily spins

Reaching a new level

Other in-app activities that may be approved by the Contest Sponsor and regulatory authority from time to time.

C. RESTRICTION TO PARTICIPATION: All Nigerians of the age of 18 and above are qualified to participate in the contest, except an employee, officer, director, representative or agent of the contest sponsor, contest sponsor parent company, subsidiaries, related or affiliated companies, advertising or promotional agencies or any company or individual engaged in the provision of goods and services related to the Contest.

D. CONTEST PERIOD: The contest period for free in-app games, Hammer Spin games and Odogwu Hunter Games shall be daily and as often as a contestant fulfils the requirement and is willing to play. The lucky draw shall be weekly. Announcements for game duration shall be in the Contest Platform and through Hammer Games' social media handles.

E. REGISTERED OWNER OF AN ACCOUNT: This is defined as the natural person who is assigned an email address, Google account, Facebook account or phone number by an Internet /service provider that is responsible for assigning such accounts associated with the contestant.

In the event of a dispute over the identity of a contestant, such entry shall be assigned to and assumed to have been submitted by the registered owner of the email address, Google account, Facebook account and or registered phone number of such contestant.

F. REJECTION: Registration shall be rejected if:

• The email address information, Google account name, Facebook account name and/or the registered phone number name is different from the registered user name of the contestant.
• The contestant’s registered name is different from any other Know Your Customer/Customer Due Diligence information submitted to Hammer Games.

G. RESPONSIBLE GAMING: We strongly believe in promoting healthy gaming practices. It's crucial that you take responsibility for your gaming behaviour. We encourage you to set limits on deposits, and losses as a means of ensuring responsible gambling. If you ever suspect any gambling-related issues, don't hesitate to seek professional assistance.

H. WALLET AND WITHDRAWAL:

• All cash prizes/winnings are stored in the user/player Dashboard, and can be paid out on request using the withdraw button in the wallet when the amount won or accumulated in the wallet is at least one thousand Naira {N1, 000 i.e. 2000 Cowries} and above.
• To withdraw from a wallet the contestant is required to log in an accurate PIN code sent to the contestant by the Contest Sponsor either through the contestant’s email and/or registered phone number. The contest sponsor reserves the right to verify every withdrawal request to ensure that the correct information is supplied by the contestant.
• Where the information supplied by the contestant is not accurate or has some discrepancies, such withdrawal requests shall not be honoured. Where repeated wrong inputs are made, the account will be flagged and suspended. A suspended account can only be reopened if accurate proof of account ownership is provided by the contestant and verified by us.
• When a contestant requests a cash prize/winning withdrawal and all information is correct, the Contest Sponsor shall pay out the cash prize/winning immediately after receiving a completed withdrawal Form while deducting applicable tax on the cash prize/winning.
• Prize money/Winnings in the contestant’s wallet can be kept in the wallet till the end of the game period if not accessed by the contestant. Contestants are therefore encouraged to withdraw their prize money/winnings always to enjoy the game experience offered by the Contest Sponsor.
• A Contestant who has purchased cowries and stored them in his/her wallet can withdraw such an amount, so long as the amount reaches the Contest’s minimal threshold for withdrawal. However, Hammer Games shall deduct 30% of the said amount as an administrative charge in all instances where a contestant has loaded his/her wallet and does not participate in any contest but instead opts to withdraw all or part of the said amount. This is to discourage money laundering through the Contest and/or Hammer Games.

7.0 RIGHTS TO SUSPEND, MODIFY AND TERMINATE

1. The Contest Sponsor shall with the approval from the regulatory authority, suspend, modify or terminate all or any part of the contest where there are circumstances that threaten the integrity or general performance of the contest.
2. The Content Sponsor will ensure that it deploys the best technologies to protect the integrity of the contest.
3. Where a particular game is compromised, the Contest Sponsor shall ensure the security of deposits and personal data of the Contestants

8.0 PUBLICITY AND INTELLECTUAL PROPERTY RIGHTS.

1. The Contest, Contest Platform and all contents therein are intellectual property of the Contest Sponsor and Contestants are to abide by these approved Terms/Rules guiding the operation of the Contest.
2. The Contest Sponsor and its authorised agents will collect, use and disclose Contestant’s personal information provided upon registration and entry into the Contest to administer the Contest and prize redemption per the Contest Sponsor’s data protection and privacy policy. The Contest Sponsor reserves the right to use such information for advertisement purposes and in marketing the Contest with the prior consent of the contestant.
3. By accepting a prize/winning, the contestant consents to publication and use of his/her name, profile pictures and or photographs, images and or likeness in any form, manner or media whether now known or hereafter devised including without limitation in print, radio, social media platforms, television, in the Contest Platform, and the internet for any purpose in connection with the Contest including but not limited for the purpose of advertising, trade and promoting the Contest Sponsor and its services without further notice or compensation to the extent that it is not inconsistent with extant laws.
4. Each Contestant hereby gives the contest sponsor consent in these regards and if the Contestant withholds consent, such Contestant shall not engage in the Contest and/or the Contest Platform.
5. For the avoidance of doubt, all rights relating to the Contest and the Contest Platform, including the name, title, design, software, literary works, artistic works and format of the contest, will rest exclusively in the Contest Sponsor for her use and at absolute discretion, unless otherwise stated.

LIMITATIONS OF LIABILITY.

The Contest Sponsor will not be liable to the Contestant for the following:

1. Any service deduction including but not limited to network charges, bank charges and deductions made on winning of the contestant by the contestant’s bank based on credit facilities entered into with the bank by the contestant.
2. Taxes that might be levied on the prize/winning.
3. Delays in communications from the contestants who won a prize to the Contest Sponsor or from the Contest Sponsor to the contestant, such as late email delivery or no email delivery, late SMS delivery or no SMS delivery, poor network and any other service-related delays that may delay or affect the completion of payment application form or cash lodgement protocols;
4. Delay in receipt of credit alert by the contestant after application and approval of cash withdrawal and consequent crediting of contestant’s bank account by the Contest Sponsor.
5. The Contest Sponsor reserves the right to cancel or modify the contest or modify or supplement the contest rules with approval from the regulatory authority.

CONFLICT RESOLUTION

1. Questions concerning the construction, validity, interpretation and enforceability of these Terms/Rules, the contestant’s rights and obligations or the rights and obligations of the Contest Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws in effect in The Federal Republic of Nigeria.
2. Where there is a conflict, the contestant is bound to exhaust the alternative dispute resolution {ADR} channels of the contest sponsor before seeking legal redress in the court of law. Any contestant who bypasses the contest sponsor’s ADR channels and proceeds to seek legal redress in court shall have his/her winning forfeited to the contest sponsor and shall be liable to pay the Contest Sponsor any litigation cost the contest sponsor may incur.
3. Where there is conflict, the contestant is encouraged to approach the Contest Sponsor as an individual. Cases will be treated on an individual basis/merit; class action is discouraged except where the facts of the conflict are one and the same.
4. The Contest Sponsor will put in place desk officers who will be in constant interaction with contestants using dedicated telephone lines, email addresses and the Contest Sponsor’s social media handles. A dedicated button on the contestant Dashboard will lead to the desk officer's interaction channels.
5. For avoidance of doubt, the Contest Sponsor’s ADR channels shall be mediation and upon the failure of mediation, then arbitration in accordance with the Arbitration and Mediation Act, 2023.
